YARD MARSHAL TERMS OF SERVICE
Effective Date: September 2, 2026
These Terms of Service (“Terms”) govern pet waste removal and related services provided by Yard Marshal LLC, doing business as Yard Marshal (“Yard Marshal,” “we,” “us,” or “our”).
By requesting a quote, creating an account, scheduling service, providing payment information, or accepting these Terms through our website or client onboarding system, you (“Customer,” “you,” or “your”) acknowledge that you have read, understood, and agreed to these Terms.
1. Services
Yard Marshal provides residential pet waste removal services, including recurring and one-time cleanups.
Available services, frequencies, and pricing may vary by service area and may change from time to time.
Recurring services may include weekly and every-other-week service. One-time and initial cleanups may also be available.
Unless otherwise stated, Yard Marshal will bag and remove collected pet waste from the property.
No long-term contract is required for recurring residential service unless a separate written agreement states otherwise.
2. Quotes and Pricing
Online quotes are based on information provided by the Customer, including the number of dogs, service frequency, property information, and the amount of accumulated waste.
Pricing displayed during online signup is generally expected to be accurate for a standard residential property. However, final pricing may be adjusted if the actual condition of the property materially differs from the information provided.
Factors that may result in additional charges include, but are not limited to:
Excessive accumulated pet waste
An unusually large property or service area
More dogs using the property than disclosed
Extended periods since the yard was last cleaned
Significant obstructions or unusual property conditions
Additional cleanup time beyond what would reasonably be expected for a standard residential yard
If a significant pricing adjustment is necessary, Yard Marshal will make reasonable efforts to notify the Customer before performing work that materially exceeds the quoted amount.
Applicable taxes may be added where required by law.
3. Initial and One-Time Cleanups
Initial and one-time cleanups may be priced differently from recurring maintenance service because of accumulated waste and the additional time required.
The Customer agrees to provide accurate information regarding the number of dogs and when the yard was last cleaned.
If the actual accumulation is substantially greater than represented during signup, Yard Marshal may adjust the cleanup price, contact the Customer for approval, reschedule the service, or decline the cleanup.
Customers who pause recurring service for an extended period may be subject to a new initial-cleanup or backlog charge when service resumes.
4. Payment and Card on File
A valid credit or debit card must be maintained on file unless Yard Marshal expressly approves another payment method.
By providing payment information, the Customer authorizes Yard Marshal and its payment-processing providers to charge the payment method on file for:
Completed recurring services
Initial cleanups
One-time cleanups
Approved additional services
Applicable taxes
Customer-caused missed-access visits
Other charges authorized under these Terms
Charges will be processed according to the billing method and schedule displayed during signup, on invoices, or in the Customer's client portal.
If payment is declined or an account becomes past due, Yard Marshal may suspend future service until the outstanding balance is paid and a valid payment method is provided.
If suspension results in substantial waste accumulation, an additional cleanup fee may apply when service resumes.
The Customer remains responsible for all services already performed and authorized charges incurred before cancellation.
5. Service Days and Arrival Times
Yard Marshal will make reasonable efforts to provide recurring service on the same designated service day.
However, a specific arrival time is not guaranteed.
Routes may change throughout the day based on traffic, weather, staffing, route optimization, customer needs, or other operating conditions.
Service days may occasionally be changed. When reasonably possible, Yard Marshal will notify affected Customers in advance.
The Customer does not need to be home during service as long as Yard Marshal has safe and unobstructed access to the service area.
6. Property Access and Gates
The Customer is responsible for providing safe, reasonable, and unobstructed access to all areas requiring service.
Gates must be unlocked on the scheduled service day unless Yard Marshal has been provided with a working key, combination, or access code.
The Customer is responsible for ensuring that:
Gates and latches are functioning properly
Access codes are current
Yard entrances are not obstructed
Fences and gates are reasonably secure
Yard Marshal has any community or neighborhood access information reasonably necessary to reach the property
Yard Marshal will make reasonable efforts to close and secure gates after service.
Yard Marshal is not responsible for failure of pre-existing, defective, damaged, improperly installed, or poorly maintained gates, fences, locks, or latches.
7. Locked Gates and Other Customer-Caused Access Problems
If Yard Marshal arrives for a scheduled visit but cannot reasonably access the service area because of a locked gate, incorrect access code, obstructed entry, unsecured aggressive animal, or another condition within the Customer's control, the visit may be considered a completed service attempt and the Customer may be charged for the scheduled visit.
When practical, Yard Marshal may attempt to contact the Customer before leaving.
Service will ordinarily resume on the next scheduled service date.
Because additional waste will have accumulated, the following visit may require additional work. Yard Marshal may choose to perform the accumulated cleanup as part of the next visit or assess an additional cleanup charge when conditions warrant.
8. Dogs and Pet Safety
Yard Marshal loves dogs, but safety comes first.
Customers must disclose any known aggressive, territorial, unpredictable, or escape-prone animals that could interfere with service.
Any dog that may pose a risk to Yard Marshal personnel must be safely secured indoors or otherwise separated from the service area before the technician arrives.
Yard Marshal may refuse to enter or immediately leave a property if an animal behaves aggressively or if the technician reasonably believes that entering or remaining in the yard would be unsafe.
A visit prevented by an unsecured or aggressive animal may be charged as a scheduled service attempt.
Customers must notify Yard Marshal when the number of dogs regularly using the property changes, including newly acquired dogs or dogs regularly staying at the property.
9. Dog Doors
Customers are responsible for informing Yard Marshal if the property has a dog door or other method through which a dog may enter the service area unexpectedly.
The Customer is responsible for securing animals when necessary to prevent unsafe interaction with Yard Marshal personnel.
10. Yard Conditions and Visibility
Yard Marshal will make reasonable efforts to locate and remove visible pet waste throughout the agreed service area.
However, pet waste may be difficult or impossible to locate when concealed by:
Excessively tall grass
Leaves
Brush
Weeds
Snow or ice
Standing water
Toys
Debris
Landscaping materials
Other obstructions
The Customer is responsible for maintaining the property in a condition that allows reasonable visibility and safe access.
Yard Marshal cannot guarantee removal of waste that cannot reasonably be seen or safely reached.
11. Weather and Unsafe Conditions
Yard Marshal intends to operate throughout the year but will not require personnel to work when conditions are unsafe.
Service may be delayed, rescheduled, or skipped because of:
Lightning
Severe thunderstorms
Extreme weather
Ice or snow
Flooding
Tornado warnings
Dangerous heat
Hazardous road conditions
Other circumstances that create an unreasonable safety risk
When practical, Yard Marshal will notify Customers of schedule changes.
If Yard Marshal does not perform a visit because of weather or another condition outside the Customer's control, the Customer will not be charged for an unperformed visit unless that service is subsequently rescheduled and completed or the applicable recurring billing arrangement expressly provides otherwise.
12. Holidays
Holiday schedules may differ from normal service schedules.
A scheduled visit may occur earlier or later than normal during a holiday week. Yard Marshal will make reasonable efforts to provide advance notice of significant schedule changes.
13. Customer-Requested Skips
Customers should request a skipped service at least 24 hours before the scheduled service day.
Requests received after the route has been finalized or after personnel have been dispatched may be charged as a scheduled visit.
Repeated or extended pauses may result in an initial-cleanup or backlog fee when regular service resumes because of accumulated waste.
14. Cancellation of Recurring Service
Recurring residential service may be cancelled at any time.
Yard Marshal requests at least 24 hours' notice before the next scheduled visit.
Cancellation does not eliminate charges for services already performed, previously authorized charges, or outstanding account balances.
If service is restarted after a significant interruption, current pricing will apply and an initial-cleanup or backlog fee may be assessed.
15. One-Time Service Cancellation
One-time cleanups may be cancelled or rescheduled with reasonable advance notice.
If a one-time cleanup is cancelled after Yard Marshal personnel have been dispatched or after arrival at the property, Yard Marshal reserves the right to charge a reasonable trip or service-attempt fee.
16. Service Quality
Yard Marshal strives to provide a thorough and professional cleanup at every visit.
If a Customer believes an area was materially missed, the Customer should notify Yard Marshal within 24 hours of service.
When the property was reasonably maintained and the affected area was visible and accessible, Yard Marshal may return to re-service the affected area at no additional charge.
This provision does not apply to waste that was hidden by excessive grass, leaves, debris, inaccessible areas, or waste deposited after Yard Marshal completed the visit.
17. Customer Property and Pre-Existing Conditions
Customers are responsible for informing Yard Marshal of hazards or unusual conditions on the property, including:
Broken gates or fences
Loose or damaged latches
Irrigation equipment
Unmarked holes
Hazardous materials
Construction areas
Unsafe structures
Hidden obstacles
Aggressive animals
Other conditions that may create a risk of injury or property damage
Yard Marshal is not responsible for damage resulting from ordinary use, normal wear and tear, pre-existing defects, unsafe property conditions, or defects that were not reasonably apparent to Yard Marshal personnel.
18. Escaped Animals
Yard Marshal personnel will make reasonable efforts to secure gates after entering and leaving a property.
However, Yard Marshal is not responsible for an animal escaping because of a pre-existing or defective fence, gate, latch, lock, dog door, enclosure, or other property condition outside Yard Marshal's control.
Nothing in these Terms limits liability that cannot legally be limited under applicable law.
19. Communications and Service Notifications
By providing a telephone number or email address, the Customer authorizes Yard Marshal and its service providers to send communications reasonably related to the Customer's account or services, including:
Arrival notifications
Service-completed notices
Schedule changes
Access problems
Billing notifications
Account information
Customer-service communications
Message and data rates may apply.
Customers may modify communication preferences where available through the client portal.
Consent to receive promotional or marketing text messages is not a condition of purchasing Yard Marshal services and may be subject to separate consent where required by law.
20. Client Portal and Account Information
Customers may receive access to an online client portal provided through Yard Marshal's service-management provider.
Customers are responsible for maintaining accurate account information, including:
Contact information
Number of dogs
Property access information
Payment information
Pet safety information
Notification preferences
Customers are responsible for protecting their login credentials and promptly notifying Yard Marshal of suspected unauthorized access.
21. Photos
Yard Marshal may take photographs reasonably necessary to document service completion, property access, gate condition, unusual property conditions, service issues, or customer complaints.
Yard Marshal will not intentionally publish identifiable photographs of a Customer's home, property, or pets for promotional purposes without appropriate permission.
22. Privacy
Personal information collected in connection with Yard Marshal services will be handled in accordance with Yard Marshal's Privacy Policy, which is incorporated into these Terms by reference.
Yard Marshal may share information with service providers reasonably necessary to operate the business, including scheduling, customer-management, payment-processing, communication, and accounting providers.
Payment-card information may be processed and stored by third-party payment processors rather than directly by Yard Marshal.
23. Limitation of Liability
To the fullest extent permitted by applicable law, Yard Marshal will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the services.
Except for liability that cannot legally be limited, Yard Marshal's aggregate liability for a claim arising from a particular service will not exceed the amount paid by the Customer to Yard Marshal for the service giving rise to that claim.
Nothing in these Terms is intended to limit liability for conduct for which limitation is prohibited by applicable law.
24. Customer Responsibility for Unsafe Conditions
The Customer is responsible for losses, injuries, or damages caused by conditions the Customer knew or reasonably should have known were unsafe and failed to disclose, including undisclosed aggressive animals or hazardous property conditions.
25. Refusal or Termination of Service
Yard Marshal reserves the right to refuse, suspend, or terminate service when reasonably necessary, including for:
Unsafe conditions
Aggressive animals
Repeated inability to access the property
Harassment or threatening behavior
Fraud
Repeated failed payments
Excessive outstanding balances
Service locations outside Yard Marshal's operating area
Conditions that make service impractical or unsafe
Any outstanding balance remains due after service is terminated.
26. Changes to Pricing or Service Terms
Yard Marshal may change prices, service offerings, policies, or these Terms from time to time.
Existing recurring Customers will receive reasonable notice of material pricing or service changes before those changes take effect whenever reasonably practicable.
Continued use of Yard Marshal services after the effective date of updated Terms constitutes acceptance of those updated Terms.
27. Governing Law
These Terms and any dispute arising from Yard Marshal services will be governed by the laws of the State of Texas, without regard to conflict-of-law principles.
To the extent permitted by law, any legal action relating to these Terms or Yard Marshal services shall be brought in a court of competent jurisdiction located in Tarrant County, Texas.
28. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.
Any invalid provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted by law.
29. No Waiver
Failure by Yard Marshal to enforce a provision of these Terms on one occasion does not waive Yard Marshal's right to enforce that provision later.
30. Entire Agreement
These Terms, together with the applicable quote, service selection, Privacy Policy, payment authorization, and any other written service-specific agreement, constitute the agreement between the Customer and Yard Marshal regarding the services.
31. Electronic Acceptance
Checking the acceptance box, clicking an acceptance button, submitting an online signup, scheduling services, or otherwise electronically agreeing to these Terms has the same effect as a handwritten signature to the extent permitted by applicable law.
